GOP states sue Biden for ending Title 42 and setting up border for ‘catastrophe’

Three Republican-led states have sued the Biden administration to stop it from ending the pandemic border policy that allowed officials to turn away migrants immediately who illegally came across the border, saying that the change would result in further chaos.

Attorneys general from Arizona, Louisiana, and Missouri on Monday announced a lawsuit filed a day earlier against the administration’s planned ending of the policy, known as Title 42, which is slated to be undone on May 23, according to Fox News.

The administration moved to lift the policy after months of pressure from immigrant advocates, who say that the rule unfairly penalizes people seeking asylum in the United States. Republicans and some Democrats have said, though, that ending the rule will lead many more people to try to cross the border and worsen the migration crisis.

“This suit challenges an imminent, man-made, self-inflicted calamity: the abrupt elimination of the only safety valve preventing this Administration’s disastrous border policies from devolving into an unmitigated chaos and catastrophe,” the complaint states.

The lawsuit points to recent statements that Democratic Sens. Kyrsten Sinema and Mark Kelly of Arizona made last week about the Biden administration’s poor planning for walking back Title 42.

“Prematurely ending Title 42 without a comprehensive, workable plan would put at risk the health and safety of Arizona communities and migrants,” said Sinema.

“This is the wrong decision. It’s unacceptable to end Title 42 without a plan and coordination in place to ensure secure, orderly, and humane process at the border,” said Kelly.

Under Title 42 of public health law, the CDC had recommended in March 2020 that people be denied admission to prevent the coronavirus from spreading at border facilities. The temporary policy was good for 60 days but has been renewed over the past two years. In that time, border officials have turned migrants away more than 1.6 million times using the authority.
